Who Pays for a Shared Fence in California? Understanding the Good Neighbor Fence Act

California homeowners often wonder: If the fence between my neighbor and me needs to be repaired or replaced, who is responsible for paying?

A leaning fence, broken boards, or an aging backyard boundary can quickly become an uncomfortable conversation between neighbors. Before you call a contractor or start planning a replacement, it is important to understand your responsibilities and the steps California law recommends homeowners take.

In California, shared boundary fences are generally addressed under the Good Neighbor Fence Act, found in California Civil Code §841.

While many homeowners assume the answer is simple — “we split the cost 50/50” — the reality is that there are important steps to follow before work begins.

Understanding the process can help you avoid unnecessary disputes, protect your relationship with your neighbor, and make smarter decisions as a homeowner.

What Is California’s Good Neighbor Fence Act?

California Civil Code §841 generally recognizes that neighboring property owners receive equal benefit from a fence that separates their properties.

Because both homeowners benefit from the fence, California law creates a rebuttable presumption that adjoining property owners share responsibility equally for the reasonable costs of:

  • Constructing a boundary fence

  • Maintaining an existing shared fence

  • Repairing or replacing a necessary fence

In simple terms:

The general starting point is that both neighbors may share reasonable fence costs equally.

However, this does not automatically mean every fence project is always split exactly 50/50.

California law allows circumstances to be considered, including whether the expense is reasonable, whether the fence benefits both properties equally, and whether requiring equal payment would be unfair based on the situation.

Before Replacing a Fence, Start With These Steps

A common mistake homeowners make is replacing the fence first and discussing payment afterward.

Even if you believe your neighbor should share the cost, California law includes a process that should happen before expenses are incurred.

Here are the steps homeowners should take.

Step 1: Confirm the Fence Is Actually a Shared Boundary Fence

Before discussing costs, make sure the fence is actually located on the property line.

A fence may appear to separate two homes, but its exact location can impact who is responsible.

Before moving forward:

  • Review available property documents

  • Check surveys if available

  • Confirm the fence location

  • Consider professional boundary verification if there is uncertainty

A fence located entirely on one homeowner’s property may involve different responsibilities.

Step 2: Document the Fence Condition

Before repairs or replacement begin, take photos and videos of the fence.

Document issues such as:

  • Leaning sections

  • Broken posts

  • Missing boards

  • Rotting wood

  • Damaged rails

  • Safety concerns

This documentation helps show why repairs or replacement may be necessary and creates a record of the fence’s condition before work begins.


Step 3: Talk With Your Neighbor First

One of the easiest ways to prevent fence disputes is communication.

Instead of starting with a bill or a demand, start with a conversation.

You might say:

“I noticed our fence is starting to deteriorate. I’d like to get some estimates and talk about options. Would you like to take a look at it together?”

Many neighbors may not even realize the fence has become a problem.

A simple conversation can help both homeowners agree on:

  • Whether repair or replacement is needed

  • Preferred materials

  • Budget expectations

  • Timeline


Step 4: Get Repair or Replacement Estimates

For a major fence project, it is helpful to get multiple estimates.

Comparing options allows both homeowners to understand:

  • Repair versus replacement costs

  • Different materials

  • Fence styles

  • Project timelines

  • Contractor pricing

Remember, California law refers to sharing reasonable costs.

If one homeowner wants a significantly more expensive fence because of personal preferences, upgrades, or design choices, those additional costs may not automatically become the neighbor’s responsibility.


Step 5: Provide 30-Day Written Notice Before Starting the Work

This is one of the most important parts of California’s Good Neighbor Fence Act.

Before a homeowner incurs costs for a shared fence project, California law requires written notice to the affected adjoining property owner.

The notice should generally include:

  • A description of the problem with the existing fence

  • The proposed solution

  • Estimated project costs

  • The proposed method for sharing expenses

  • The expected timeline

  • Notice regarding the legal presumption that neighbors may share reasonable fence costs

The purpose of this notice is to give both homeowners an opportunity to discuss the project before money is spent.

Do not wait until after the fence is completed and then send your neighbor a bill.


Does the Fence Cost Always Have to Be Split 50/50?

No.

While California law creates a presumption that neighbors share reasonable fence costs equally, that presumption can be challenged depending on the circumstances.

Factors that may affect responsibility include:

  • Whether the cost is disproportionate to the benefit received

  • Whether the project is unnecessarily expensive

  • Whether one homeowner’s preferences increased the cost

  • Whether equal payment would create financial hardship

  • Whether the fence provides equal benefit to both properties

This is why communication and proper planning are so important before starting the project.


What Happens If Your Neighbor Refuses to Pay?

If your neighbor disagrees about the fence project or refuses to contribute, avoid immediately turning the situation into a conflict.

Keep records of:

  • Photos

  • Estimates

  • Written notices

  • Messages or conversations

  • Agreements

Try to find a reasonable solution first.

If the disagreement involves significant costs or cannot be resolved, consider consulting a qualified California real estate attorney regarding your specific situation.


The Biggest Takeaway for California Homeowners

A damaged fence can create frustration, but replacing it does not have to create conflict.

Before starting a fence project:
